RE: ADOPTION OF MANDATORY COMMERCIAL CONSTRUCTION PERMITTING
BOARD RESOLUTION AND ORDER
BE IT RESOLVED, by the Board of Supervisors of Panola County, Mississippi, meeting in regular session on this the 5th day of October, 2026, that the Board hereby formally adopts, establishes, and mandates that all commercial construction within the unincorporated areas of Panola County, Mississippi, shall be subject to the following regulatory requirements, permitting procedures, and administrative oversight enforced through the Panola County Land Development Office:
- Mandatory Commercial Permitting: All commercial construction, building, and development projects within Panola County must obtain a formal building and development permit issued by the Panola County Land Development Office prior to the commencement of any site work, foundation pouring, or construction. The commercial building permit fee shall be assessed at the rate of $0.40 per square foot.
- Planning Commission Approval: No commercial permit shall be issued until the commercial structure, site plan, and intended use have been formally reviewed and approved by the Panola County Planning Commission, ensuring compliance with county land use regulations and comprehensive development standards.
- Zoning Setback Verification: The Land Development Office shall review all commercial site plans to verify and ensure that the proposed structure strictly meets all required building setbacks, yard requirements, and dimensional standards established for the specific zoning district in which it is located.
- E-911 Addressing Assignment: Prior to permit issuance and construction commencement, the Land Development Office shall verify and assign the proper E-911 physical address for the commercial parcel to ensure accurate emergency service dispatch and public safety access.
- Floodplain Determination: All commercial applications shall be evaluated to determine whether the proposed construction site lies within a Special Flood Hazard Area (Flood Zone), ensuring full compliance with the Panola County Flood Damage Prevention Ordinance, including mandatory freeboard and elevation standards.
- Temporary and Permanent Electrical Power Releases: The Building Official is authorized to withhold or issue electrical service releases. No utility provider shall supply temporary or permanent electrical power to any commercial structure until all building, zoning, floodplain, and addressing requirements have been fully satisfied and a final electrical release has been officially issued by the County.
IT IS FURTHER ORDERED that this resolution and mandatory permitting policy shall be spread at large upon the official minutes of the Panola County Board of Supervisors, taking effect immediately upon passage.
